1. Acceptance of Terms
By accessing or using Graphite ("Service"), operated by CodePerfect ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We recommend reviewing these Terms periodically, as your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
Graphite is an AI-powered diagram generation tool that enables users to create visual diagrams, charts, and infographics through natural language prompts. The Service utilizes third-party artificial intelligence providers, including OpenAI and Google (Gemini), to process user inputs and generate diagram content.
The Service supports multiple diagram formats including Mermaid diagrams, D2 diagrams, Vega/Vega-Lite visualizations, and infographics. Users can export their generated content in various formats including SVG and PNG.
3. User Accounts
The Service offers both anonymous access and registered account options. Anonymous users may access limited functionality without creating an account. For full functionality, users may create an account using:
- Google OAuth authentication
- Microsoft OAuth authentication
- Email and password registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. User Content and Intellectual Property
Your Content: You retain full ownership of any diagrams, prompts, and content you create using the Service. By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service to you.
No AI Training: Your prompts, diagrams, and content are used exclusively to deliver the Service and are not used to train or improve any AI models.
Our Content: The Service, including its design, features, and underlying technology, is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
5. Acceptable Use Policy
You agree not to use the Service to:
- Generate illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
- Create content that infringes on any third party's intellectual property rights
- Attempt to circumvent, disable, or interfere with security features of the Service
- Use automated scripts, bots, or other means to access the Service in an unauthorized manner
- Overload, impair, or disrupt the Service or its underlying infrastructure
- Violate any applicable local, provincial, national, or international law or regulation
We reserve the right to terminate or suspend your access to the Service for violations of this policy.
6. AI-Generated Content Disclaimer
The Service uses artificial intelligence to generate diagrams and visualizations. You acknowledge that:
- AI-generated content may contain errors, inaccuracies, or unexpected results
- The quality and accuracy of generated content depends on the clarity and specificity of your prompts
- You are solely responsible for reviewing and validating any content generated by the Service before use
- We make no guarantees regarding the accuracy, completeness, or suitability of AI-generated content for any particular purpose
- AI outputs should not be relied upon for critical decisions without independent verification
7. Third-Party Services
The Service integrates with and relies upon various third-party services to function. By using the Service, you acknowledge that your data may be processed by:
- OpenAI: For AI-powered diagram generation
- Google (Gemini): For AI-powered diagram generation
- Vercel: For application hosting and infrastructure
- Langfuse: For service monitoring and observability
- Google and Microsoft: For OAuth authentication (if you choose these sign-in methods)

8. Donations and Payments
The Service currently operates on a donation-based model. Donations are voluntary and are used to support the continued development and operation of the Service.
We reserve the right to introduce paid subscription tiers or other payment models in the future. Any such changes will be communicated to users in advance, and additional terms governing payments, billing, and refunds will be provided at that time.
9. Account Termination and Data Retention
By You: You may discontinue using the Service at any time. You may also request deletion of your account and associated data by contacting us.
By Us: We reserve the right to suspend or terminate your access to the Service for violations of these Terms, suspicious activity, or any other reason at our sole discretion.
Inactive Accounts: We reserve the right to delete accounts and associated data that have been inactive for more than one (1) year. We will attempt to notify you via email before such deletion where possible.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Aleksandr Tsimbalistov and any affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the courts located in the Province of Ontario, Canada.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or for other reasons. We will notify you of material changes by posting the updated Terms on the Service and updating the "Effective Date" above. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
